Court Whacks Obamacare

Judge strikes down healthcare reform law

The 26 state suit against B.O.’s version of a National Health Service prevails in it’s initial court test presumably on the way to a SCOTUS hearing (sooner or later).

A federal judge in Florida struck down President Barack Obama’s landmark healthcare overhaul as unconstitutional on Monday in the biggest legal challenge yet to federal authority to enact the law.

U.S. District Judge Roger Vinson ruled that the reform law’s so-called individual mandate went too far in requiring that Americans start buying health insurance in 2014 or pay a penalty.

“Because the individual mandate is unconstitutional and not severable, the entire act must be declared void,” he wrote, “This has been a difficult decision to reach and I am aware that it will have indeterminable implications.”

Referring to a key provision in the Patient Protection and Affordable Care Act, Vinson sided with governors and attorneys general from 26 U.S. states, almost all of whom are Republicans, in declaring the Obama healthcare reform unconstitutional.

What makes this even sweeter is the fact that the decision was based to some extent on B.O.’s own comments. Hoist on his own petard!

Judge uses Obama’s words against him

In ruling against President Obama‘s health care law, federal Judge Roger Vinson used Mr. Obama‘s own position from the 2008 campaign against him, when the then-Illinois senator argued there were other ways to achieve reform short of requiring every American to purchase insurance.

“I note that in 2008, then-Senator Obama supported a health care reform proposal that did not include an individual mandate because he was at that time strongly opposed to the idea, stating that, ‘If a mandate was the solution, we can try that to solve homelessness by mandating everybody to buy a house,’” Judge Vinson wrote in a footnote toward the end of his 78-page ruling Monday.

Once the principle of forcing behavior (whether buying health insurance, or anything else) is established, there is, of necessity no remaining legal restraint on the power of the state to compel ANY behavior in any other areas that attract the attention of our would-be progressive masters.  Perhaps, for example, to satisfy the 1st Lady’s concern for proper nutrition there could be a federal law mandating that everyone eat their vegetables, or that pedestrians must wear crash-helmets for their own safety, or whatever else the nanny-state advocates can dream up to protect us from ourselves.

This sort of crap is NOT the proper role of  our Constitutional government.

House GOP dares Senate to vote on a bill to repeal ‘Obamacare’

House Republicans already are looking past Wednesday’s expected vote to repeal Democrats’ health care law, going so far as to dare Senate Democrats to bring the bill up for a vote in their chamber.

“If Harry Reid is so confident that the repeal vote should die in the Senate then he should bring it up for a vote if he’s so confident he’s got the votes,” House Majority Leader Eric Cantor, Virginia Republican, told reporters, laying down a challenge to Mr. Reid, the Nevada Democrat who controls the Senate schedule.

Uf the Senate votes it down, c’est la vie…that’s politics…but one starts to wonder whether or not Reid is really confident that his own partisans, especially those up for election in 2012 will hang tough. Either way, the outcome of a Senate vote would be instructive on one level or another.

President Obama has a solution to the Gulf oil spill: $7-a-gallon gas.

That’s a Harvard University study’s estimate of the per-gallon price of the president’s global-warming agenda. And Obama made clear this week that this agenda is a part of his plan for addressing the Gulf mess.

So what does global-warming legislation have to do with the oil spill?

Good question, because such measures wouldn’t do a thing to clean up the oil or fix the problems that led to the leak.

The answer can be found in Obama Chief of Staff Rahm Emanuel’s now-famous words, “You never want a serious crisis to go to waste — and what I mean by that is it’s an opportunity to do things that you think you could not do before.”

Prima facie, B.O. and his ilk are nearly totally lacking in situational awareness with regards to the greater part of the votors. The prevailing White House philosophy seems to be “How can we fool them again?”

63% Favor Repeal of National Health Care Plan

Support for Obamacare continues to slip:

Support for repeal of the new national health care plan has jumped to its highest level ever. A new Rasmussen Reports national telephone survey finds that 63% of U.S. voters now favor repeal of the plan passed by congressional Democrats and signed into law by President Obama in March.

Prior to today, weekly polling had shown support for repeal ranging from 54% to 58%. Currently, just 32% oppose repeal.

The new findings include 46% who Strongly Favor repeal of the health care bill and 25% who Strongly Oppose it.

While opposition to the bill has remained as consistent since its passage as it was beforehand, this marks the first time that support for repeal has climbed into the 60s. It will be interesting to see whether this marks a brief bounce or indicates a trend of growing opposition.

What happened to all those assertions from ObamaPelosiReid that once the bill passed and people knew what was in it that it would magically become popular? Oooops!

Report: Health overhaul will increase USA’s tab

President Obama’s health care overhaul law will increase the nation’s health care tab instead of bringing costs down, government economic forecasters concluded Thursday in a sobering assessment of the sweeping legislation.

A report by economic experts at the Health and Human Services Department said the health care remake will achieve Obama’s aim of expanding health insurance — adding 34 million Americans to the coverage rolls.

But the analysis also found that the law falls short of the president’s twin goal of controlling runaway costs. It also warned that Medicare cuts may be unrealistic and unsustainable, driving about 15% of hospitals into the red and “possibly jeopardizing access” to care for seniors.

The mixed verdict for Obama’s signature issue is the first comprehensive look by neutral experts.

Support for Repeal of Health Care Plan Up To 58%

Three weeks after Congress passed its new national health care plan, support for repeal of the measure has risen four points to 58%. That includes 50% of U.S. voters who strongly favor repeal.

The latest Rasmussen Reports telephone survey of likely voters nationwide finds 38% still oppose repeal, including 32% who strongly oppose it.

If one examines the other dynamics of this poll, there isn’t anything to give the administration a warm glow about…unless of course it’s heartburn!

Sorry: No bump for Obamacare

Last September, just as public opinion was beginning to turn against Obamacare in a serious way, Bill Clinton made a bold prediction. “The minute health care reform passed,” he said in a policy forum in New York City, “President Obama’s approval ratings would go up 10 points.” Clinton’s prediction reflected the wishful assumption of many wishful liberal-leaning pundits and think tank analysts, as well as the strategy of Obama’s political advisers. They viewed the rising public clamor against Obamacare as a temporary aberration, not as a lasting problem that could potentially undo his presidency. When Obamacare passed, they confidently reasoned, the public would suddenly appreciate its virtues and acquiesce to federal control over nearly every aspect of health care.

Looks like Bubba blew it on that prediction, and things aren’t looking too hot for B.O. on this:

Meanwhile, polls continue to show a strong majority opposing Obamacare and favoring its repeal. The latest Fox News poll puts the opposition at 55 percent, with 39 percent in favor. This reading comes despite Obama’s backward-looking campaign tour in recent weeks to build public support for Obamacare, something he and his party were unable to do during the year prior to its enactment. The Democrats assumed they had to pass a health care reform bill, any bill, regardless of the depth or intensity of opposition. Failure, they reasoned, would harm them at the polls. As it turned out, their success may kill them in November.

But wait…surely B.O. is doing better otherwise now that the divisive Obamacare debate is over, right?

Er…maybe not so hot there, either:
